BreadTalk Rewards Program Terms & Conditions

Please read these Terms & Conditions / Terms of Use / Terms for BreadTalk Rewards Program (Singapore) carefully. By accessing or using this program, you agree to be bound by the Terms described herein unconditionally and all Terms incorporated by reference and will comply with these Terms at all times.

These Terms of Use apply to your access to and participation in, the BreadTalk Rewards program which is operated by BreadTalk Pte. Ltd. (“BreadTalk”), a subsidiary of BreadTalk Group Pte. Ltd. in Singapore.

These Terms of Conditions do not alter in any way the terms or conditions of any other agreement(s) you may have with BreadTalk for products, services or otherwise.

BreadTalk reserves the right to change, modify and/or terminate the BreadTalk Rewards program and/or these Terms & Conditions or any policies, FAQ, or guidelines pertaining to BreadTalk Rewards at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.breadtalkrewards.com, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in BreadTalk Rewards Program confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to BreadTalk Rewards program. If you do not agree to these Terms of Use, you may stop participating in BreadTalk Rewards program.

BreadTalk Rewards program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only use BreadTalk Rewards program under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Please read the BreadTalk Privacy Policy carefully to understand how BreadTalk collects, uses and discloses information about its customers.

BreadTalk Rewards Program

Program overview

BreadTalk Rewards Program is one way in which BreadTalk aims to reward and thank loyal customers for patronizing BreadTalk and Toast Box stores (the “stores”) in Singapore. To join our BreadTalk Rewards Program and receive program privileges, you will first need to create a “BreadTalk Rewards” account at www.breadtalkrewards.com or with a BreadTalk Rewards mobile application distributed by BreadTalk in Singapore (“BreadTalk Rewards mobile app”) and then register at least one (1) Singapore activated BreadTalk Rewards Card to your account. BreadTalk Rewards Card activated in Singapore may include physical BreadTalk Rewards branded plastic cards that are available and activated in participating stores in Singapore, as well as digital forms of the cards that are available and activated through our BreadTalk Rewards mobile app or our BreadTalk Rewards website.

In these Terms of Use, “activation” means that you have registered an account with your Singapore registered mobile number, and linked an existing physical BreadTalk Rewards branded plastic card or purchased a digital card in your account. You can register any BreadTalk Rewards Card activated in Singapore to your BreadTalk Rewards account. The term “BreadTalk Rewards Card” refers to a BreadTalk Rewards Card that may be activated in Singapore only, and the term “registered BreadTalk Rewards Card” refers to a BreadTalk Rewards Card that has been activated in Singapore and registered to your BreadTalk Rewards account at www.breadtalkrewards.com or through our BreadTalk Rewards mobile app.

The BreadTalk Rewards Card registration process may require that you provide certain personal information using the online registration form, including: mobile number, password, email address, BreadTalk Rewards Card number, birthday, name, gender, and marketing preferences. All of your BreadTalk Rewards Cards activated in Singapore can be registered for use in the BreadTalk Rewards Program under these Terms of Use, but you may only have one (1) account personal to you.

Your complimentary birthday reward will be automatically loaded into your registered BreadTalk Rewards Card to be used during your birthday month only.

Your complimentary welcome gift will be automatically loaded into your registered BreadTalk Rewards Card to be used within the first month after you have successfully registered.

Additional personalised offers, promotions and event invitations may be distributed by email or SMS, so you must opt-in to receive such promotional and marketing offers from BreadTalk. You must provide a valid email and mobile number in order to receive the additional offers, promotions and event invitations.

BreadTalk Rewards Card

The BreadTalk Rewards Card is issued to you by BreadTalk. It allows you to load a monetary value onto your BreadTalk Rewards Card for future purchases at participating stores. The BreadTalk Rewards Card is to be treated like cash. It cannot be replaced if lost, stolen or destroyed and you are encouraged to report the loss immediately. Unfortunately, BreadTalk Rewards will not be liable for any loss of stored value or e-vouchers resulting from the loss of card by the cardholder. A replacement of the BreadTalk Rewards card together with any unutilised stored value or e-vouchers is strictly subject to BreadTalk’s discretion. The monetary value that you load onto your BreadTalk Rewards Card is a pre-payment only for the goods and services of participating stores. No credit card, credit line, overdraft protection or deposit account is associated with a BreadTalk Rewards Card. No interest, dividends or any other earnings on funds loaded on to a BreadTalk Rewards card will accrue or be paid or credited to you by BreadTalk. The value associated with the BreadTalk Rewards Card is not insured or guaranteed by any person or entity.

We reserve the right not to accept any BreadTalk Rewards Card or otherwise limit the use of a BreadTalk Rewards Card if we reasonably believe that the use is fraudulent or otherwise unlawful.

Loading Value on Your Card

In Singapore, you can load value onto a BreadTalk Rewards Card by using a credit card, debit card or cash by visiting any participating store. You may also top-up an existing BreadTalk Rewards Card by using a credit or debit card online through our website at www.breadtalkrewards.com or via our BreadTalk Rewards mobile app, or by other means as we may designate from time to time. If you choose to top-up your BreadTalk Rewards Card online, or through our BreadTalk Rewards mobile app, any personal data which you provide to us in order to do so will be held pursuant to BreadTalk Privacy Policy and by proceeding with the topping up facility, you agree to this arrangement.

The value of your BreadTalk Rewards Card is subject to the following load limits: a maximum value of S$300 may be stored on any BreadTalk Rewards Card at any given time, and the minimum amount that can be loaded is S$30. BreadTalk may change these maximum and minimum amounts at any time by notifying you at the point of sale or on the BreadTalk Rewards website and such change shall not constitute an amendment to these Terms save for the notified change as aforesaid.

BreadTalk does not charge any fees for the issuances, activation, use or reloading of your BreadTalk Rewards Card unless otherwise stated.

Receipts and Statements

Cardholders are not sent statements of itemised transactions from a BreadTalk Rewards Card account. You can check the balance of your BreadTalk Rewards Card or review the last nine (9) months’ worth of transactions on your BreadTalk Rewards Card on our website at www.breadtalkrewards.com or on our BreadTalk Rewards mobile app, or by calling +65 66028113. When you use your BreadTalk Rewards Card at a participating store, you will receive a receipt but will not be asked to sign the receipt. The receipt will indicate that a purchase has been made using a BreadTalk Rewards Card and will provide the remaining balance of your BreadTalk Rewards Card. You should keep your receipts and check your online statement to ensure that your account balance is correct.

Redemption

All reward privileges are valid only within their stipulated periods.

Refund

Refund of the balance value on your BreadTalk Rewards Card can only be made by sending a request to friends@breadtalk.com.

We require the following documents to be produced for a refund to be processed: the original receipt of the last purchase or top-up transaction, along with documentation of your identity such as your full name, contact number, and a copy of bank statement within the last 3 months that indicates your Bank Account number

An administration fee of S$10.00 will be imposed per refund transaction.

Complaint Handling

We reserve the right to correct the balance of your BreadTalk Rewards Card account if we believe that a clerical, billing or accounting error has occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your BreadTalk Rewards Card, please contact our Customer Service Team by phone on +65 66028113 or by email friends@breadtalk.com and we will conduct an investigation, and provide an update as soon as we finish the investigation. If no error was found, we will communicate an explanation. We accept no liability for any billing error unless you provide us notice within thirty (30) days of the date of the transaction in question. Please monitor your transactions and account balances closely.

Optional Registration; Liability for Transactions

As your BreadTalk Rewards Card is used like cash for purchases from BreadTalk, you are responsible for all transactions associated with your BreadTalk Rewards Card, including mobile transactions. However, if your BreadTalk Rewards Card is lost, stolen or destroyed, the digital card can be replaced with the balance remaining on it, but only if you have registered the card with us. To register your BreadTalk Rewards Card, please visit our website at www.breadtalkrewards.com. You may also register your BreadTalk Rewards Card through our BreadTalk Rewards mobile app. Please notify us immediately if you change any of your registration information. Personal information which you provide to us for purposes of registering your BreadTalk Rewards Card will be held pursuant to BreadTalk Privacy Policy. If your registered BreadTalk Rewards Card is lost, stolen or damaged, you should report the loss via the BreadTalk Rewards mobile app, or contact us at friends@breadtalk.com or +65 66028113 from Mondays to Fridays, 9am to 6pm, excluding Public Holidays and Eve of Public Holidays. Your BreadTalk Rewards Card balance is only protected from the point in time that you notify us that the Card is lost, stolen or damaged. We will freeze the remaining balance on your BreadTalk Rewards Card at the time you notify us and will load that remaining balance on your replacement digital card after verification.

Apple and Google Terms & Conditions and BreadTalk Policies

These Terms supplement and incorporate (a) in case the Application is distributed through Apple Inc.’s (“Apple”) system, Apple’s Terms and Conditions (located at www.apple.com/legal/itunes/us/terms.html#service) including, without limitation, the Licensed Application End User License Agreement provided therein (“Apple Terms”); and (b) in case the Application is distributed through Google Inc’s (“Google”) system, Google Play Terms of Service (located at http://play.google.com/about/play-terms.html) (“Google Terms”) and (c) other BreadTalk policies (“BreadTalk Policies”), including the terms of use for the BreadTalk Rewards Website and the BreadTalk Rewards Card, posted at www.breadtalkrewards.com (“BreadTalk Rewards Website”). If any of the provisions of the Apple Terms, Google Terms or any applicable BreadTalk Policies conflict with these Terms, these Terms will control, solely to the extent that such terms apply to the Application.

User License

Subject to these Terms, BreadTalk grants you (the “User”) a personal, non-exclusive, non-transferable, limited and revocable license to use the Application for personal and/or non-commercial use only on an Apple iPhone, iPad or iPod Touch or an Android device (each a “Device”) owned or controlled by User as permitted by the Apple Terms or the Google Terms and in accordance with these Terms (“User License”). Any use of the Application in any other manner, including, without limitation, resale, transfer, modification or distribution of the Application or text, pictures, music, barcodes, video, data, hyperlinks, displays and other content associated with the Application (“Content”) is prohibited. These Terms and User License also govern any updates to, or supplements or replacements for, this Application unless separate terms accompany such updates, supplements or replacements, in which case the separate terms will apply.

Online Functionalities

Users who download the Application to a Device may also elect to participate in certain functionalities of the Application which will allow the User to use a Device to load value to a BreadTalk Rewards stored value Card (“BreadTalk Rewards Card”) in accordance with these Terms and the BreadTalk policies including the BreadTalk Rewards Card Terms and Conditions (located at www.breadtalkrewards.com). BreadTalk reserves the right at any time to discontinue any or all of the functions of Online Payment.

User Information

ome functionality of the Application, including Online Payment, location based services and functionality, may require the transmission of information provided by the User including but not limited to user names and passwords, addresses, e-mail addresses, financial information (such as credit card numbers), the International Mobile Equipment identity number accessed in the User’s Device, phone-book information, information related to a BreadTalk Rewards Card or GPS location (“User Information”). If the User uses such Application functionality, the User consents to the transmission of User Information to BreadTalk, its agents and/or service providers and authorizes BreadTalk, its agents and/or service providers to record, process and store such User Information as necessary for the Application functionality and for purposes described in the BreadTalk Privacy Policy (located at http://www.breadtalk.com/en/privacy-policy/.

The User is solely responsible for maintenance of the confidentiality and security of any User Information transmitted from or stored on a Device for purposes of the Application, including Online Payment, for all transactions and other activities undertaken with any BreadTalk Rewards Card registered in the User’s name, whether authorised or unauthorised. The User agrees to immediately notify BreadTalk of any unauthorised transactions associated with the Application including Online Payment or any other breach of security. BreadTalk shall not be responsible for any losses arising out of the loss or theft of User Information transmitted from or stored on a Device or from unauthorised or fraudulent transactions associated with the Application.

Acceptable Use

Use by the User of the Application and any Content and User Information transmitted in connection with the Application is limited to the contemplated functionality. The User agrees that his or her use of the Application and any Content must comply with these Terms and the BreadTalk Policies. In no event may the Application be used in a manner that (a) harasses, abuses, stalks, threatens, defames or otherwise infringe or violate the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent or deceptive; (c) uses technology or other means to access the Application, BreadTalk Rewards Website or Content that is not authorized by BreadTalk; (d) use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," to access the Application, BreadTalk Rewards Website or Content; (e) attempts to introduce viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) attempts to gain unauthorised access to BreadTalk computer network or user accounts; (g) encourages conduct that would constitute a criminal offense, or that gives rise to civil liability; (h) violates these Terms; (i) attempts to damage, disable, overburden, or impair BreadTalk servers or networks; or (j) fails to comply with applicable third party terms (collectively “Acceptable Use”).

BreadTalk reserves the right, in its sole discretion, to terminate any User License, terminate any User’s participation in Online Payment, remove Content or assert legal action with respect to Content or use of the Application, including Online Payment, that BreadTalk reasonably believes is or might be in violation of these terms of Acceptable Use or BreadTalk Policies including the BreadTalk Rewards Card Terms and Conditions, but BreadTalk failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.

Indemnification

You agree to defend, indemnify, and hold harmless BreadTalk and its parent and other affiliated companies, and their employees, contractors, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, expenses (including attorney's fees) that arise from the User’s use or misuse of the Application (including Online Payment), violation of these Terms or violation of any rights of a third party. BreadTalk reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defences. In the event of any third party claim that the Application or User’s possession and use of the Application infringes that third party’s intellectual property right, BreadTalk, not Apple or Google, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.

Miscellaneous

Rewards are loaded electronically to your BreadTalk Rewards account. You can view and track your available rewards at www.breadtalkrewards.com or through our BreadTalk Rewards mobile app. Rewards may only be redeemed in participating BreadTalk and Toast Box stores in Singapore. To redeem a reward under BreadTalk Rewards, you must present any of your registered BreadTalk Rewards Card to the cashier. For each reward item, only one reward will be given per one BreadTalk Rewards account, regardless of the number of BreadTalk Rewards Cards that you have registered to that account.

Unless specifically provided to the contrary, only one reward may be redeemed with each transaction regardless of the membership level. This means that you cannot use more than one reward together in the same transaction.

There are no membership fees associated with BreadTalk Rewards Program.

BreadTalk may introduce promotion programs relating to BreadTalk Rewards Program whereby these Terms of Use may be varied as applicable to such programs.

Your privileges, registered BreadTalk Rewards Card(s), and your account under BreadTalk Rewards Program are personal to you, and except as expressly permitted under these Terms of Use or the rules of a promotional program, may not be sold, transferred or assigned to, or shared with family, friends or others.

BreadTalk reserves the right to terminate your account and/or your participation in BreadTalk Rewards Program if BreadTalk determines in its sole discretion that you have violated these Terms of Use, or that the use of your account is unauthorised, fraudulent or otherwise unlawful.

BreadTalk also reserves the right to “unregister” and make ineligible for BreadTalk Rewards Program any BreadTalk Rewards Card that has been inactive for two (2) consecutive years. In these Terms of Use, “inactive” is defined as having no top up activity.

BreadTalk reserves the right to terminate, discontinue, modify or cancel the BreadTalk Rewards Program at any time and in its sole discretion by posting the revisions to www.breadtalkrewards.com without giving specific notice to you.

IMPORTANT LEGAL TERMS

Changes to these Terms

We may amend the Terms at any time for security, legal, regulatory or valid business reasons. We will post the terms to the modified Terms on our website at www.breadtalkrewards.com. Subject to the remainder of this clause, any change, addition or deletion will become effective at the time we post the revised Terms to our website, BreadTalk Rewards mobile app or in our stores. Unless we state otherwise, the change, addition or deletion will apply to your future and existing BreadTalk Rewards Cards. The amended terms will apply to you if you continue using your BreadTalk Rewards Card. If you do not accept the changes, additions or deletions, you shall stop participating in BreadTalk Rewards program by notifying us at friends@breadtalk.com. Your BreadTalk Rewards Card will be cancelled and any amounts remaining on your BreadTalk Rewards Card will be refunded to you as per the refund terms above.

Cancellation of these Terms

We may suspend or terminate these Terms and the BreadTalk Rewards Card Program at any time by giving you reasonable prior notice. We need not, however, give you notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent use of the BreadTalk Rewards Card). If we terminate in circumstances where it is determined you are not in breach of these Terms, we will refund or issue store credits equal to the balance held in your BreadTalk Rewards Card account less any amounts that you owe us. In the event of such termination by us, this Part Two (Important Legal Terms) shall continue to apply as between us in respect of anything either of us did whilst these Terms were in force.

Governing Law

These Terms are governed by the laws of Singapore.

Disclaimers and Limits of Liability

BreadTalk does not represent or warrant that your BreadTalk Rewards Card will always be accessible or accepted at participating BreadTalk and Toast Box stores.

In the event that BreadTalk is held liable to you under these Terms, you will be entitled to recover from us your actual damages, up to the last balance held on your BreadTalk Rewards Card in question.

BreadTalk will not be liable to you for:

These Terms do not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights you should contact a lawyer.

Assignment

We may transfer all or part of these Terms without such transfer being considered a change to these Terms between us, by giving notice to you. The company or other entity to whom we transfer these Terms will have the same rights and obligations as we did before the transfer and we will ensure that it agrees in writing to be bound by these Terms and Conditions so that your rights are not detrimentally affected and we will then be released from all liability.

You may not assign, novate or otherwise transfer any and all of your rights, benefits or obligations under these Terms without our prior written approval.

Entire Agreement; Construction

All correspondence entered into under these Terms will be in the English language. These Terms are the complete and exclusive statement of agreement between you and BreadTalk and supersedes all prior proposals and all other agreements in respect of the subject matter of these Terms. If any provision of these Terms are illegal or unenforceable, that provision will be deleted from these Terms, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of these Terms.
